Update Your Details Terms & Conditions
This document sets out the terms and conditions of entry and participation for the Solotel ‘update your details’ promotion (Promotion).
The Promotion is conducted by Solotel Management Pty Limited as trustee for the Solotel Management Unit Trust ABN 85 498 091 676, whose registered office is at Level 2, 429 New South Head Road Double Bay NSW 2028 (Promoter).
These terms and conditions of entry (Conditions of Entry) apply to the Promotion and, by submitting an entry to the Promotion, an entrant agrees to and will be bound by these terms and conditions.
This Promotion is a game of skill and chance plays no part in the Promotion (including the selection of winners).
Eligibility
1 Entry is only open to Australian residents aged 18 years or over.
2 Employees of the Promoter or any relevant Solotel venue (or their immediate family members) are ineligible to enter the Promotion.
3 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process.
4 An entrant is not required to pay an entry fee and no purchase of any products or services of the Promoter is necessary to enter this Promotion.
Entry
5 The Promotion commences on 07:00 AEDT on 7/03/2020. Entries close at 11.59PM AEDT on 6/03/2020 (Promotional Period).
During the Promotional Period, any person that updates their contact details via a Solotel website (including any website of a relevant Solotel venue) will be able to enter the Promotion. To enter the Promotion, a person must, during the Promotional Period:
(a) complete the ‘update your details’ form accessible via the relevant Solotel website;
(b) select the entrant’s favourite Solotel venue (listed in clause 10); and
tell the Promoter, in the space provided, in 25 words or less what the entrant loves the most about the entrant’s favourite Solotel venue (Answer Response).
6 No responsibility is accepted for late, lost or misdirected entries. Incomplete, indecipherable or illegible entries will be deemed invalid.
7 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
8 Only one entry per person to the Promotion is permitted.
9 The Promotion involves a game of skill, and no element of chance plays a part in determining the winners of the Prize Vouchers (as defined in clause 10).
Prizes and winning
10 The prize comprises 50 vouchers for the value of $100AUD which may be used at one of the following Solotel venues nominated by the entrant (Prize Vouchers):

11 The total value of the Prize Vouchers is $5,000.
12 Unless otherwise agreed by the Promoter, an entrant will only be eligible to win one of the Prize Vouchers.
13 The Prize Vouchers are as stated and no cash or other alternative prizes will be offered.
14 The Promoter, or persons nominated by the Promoter, will determine the winners of the Prize Vouchers based on an assessment of the creativity of the Answer Responses received during the Promotional Period (with the eligible entries considered by Solotel to be the 50 most creative entries being selected as the winners)
15 The winners of the Prize Vouchers will be notified by email and telephone within 30 days of the end of the Promotional Period.
16 In the event that a winner is unable to be contacted within 7 days of the period set out in clause 15, the Promoter may elect another winner (being the entry that the Promoter considers to be the next most creative entry), subject to any written directions given by a regulatory authority.
17 The Promoter’s decision is final.
18 The Prize Vouchers are not transferable or exchangeable.
19 The Promoter will notify the winners of how and when they can collect their Prize Voucher.
20 Subject to the unclaimed prize procedure in clause 16, if for any reason a winner does not redeem their Prize Voucher at the time stipulated by the Promoter, then that winner’s Prize Voucher will be forfeited.
21 If the Prize Voucher is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize Voucher with a prize to the equal value, subject to any written directions from a regulatory authority.
General
22 The entrant grants to the Promoter a royalty-free, irrevocable, worldwide licence to use the Answer Response for any purpose, including to display the Answer Response on the Promoter’s social media accounts and websites (including the social media accounts and websites of any relevant Solotel venue).
23 This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social media network.
24 The Promoter reserves the right to require a winner to provide proof of identity satisfactory to the Promoter (in its sole discretion) before awarding the Prize Voucher.
25 If required by legislation governing the conduct of the Promotion, the Promoter will provide details of the winners (such as the name and address) to any applicable government authority.
26 The winners must comply with all reasonable directions or instructions of the Promoter in order to receive the Prize Voucher.
27 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, subject to any written directions from a regulatory authority, the Promoter may modify, suspend, terminate or cancel the Promotion, as appropriate.
28 Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the consumer guarantee provisions of the Australian Consumer Law.
29 Subject to paragraph 28 and to the extent permitted by law, the Promoter excludes all liability to the winners for any costs, expenses, losses and damages suffered or incurred by the winners, including any liability for personal injury or death, liability due to negligence of the Promoter or their personnel, whether direct, indirect, special or consequential, arising in connection with the Promotion or the Prize Vouchers.
30 The Promotion and these Conditions of Entry are governed by the laws in force in New South Wales. The parties submit to the nonexclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia and any courts that may hear appeals from those courts about any proceedings in connection with this Promotion or the Conditions of Entry.
Privacy
31 The Promoter will collect the personal information provided by an entrant for the purpose of conducting the Promotion, including providing any Prize Voucher to an entrant and to contact the entrant for promotional and marketing purposes, as described below.
32 If an entrant does not provide the requested personal information, the Promoter will not be able to accept an entry as being a valid entry in the Promotion or allow an entrant to participate in the Promotion.
33 By entering the Promotion an entrant consents to the Promoter using their personal information for promotional and marketing purposes regarding the Promoter’s products, services and events, as set out in the Promoter’s Privacy Policy.
34 The Promoter may also disclose an entrant's personal information to the commercial partners of the Promoter relevant to the Promotion (including the relevant Solotel venue nominated by the individual). By entering the Promotion an entrant consents to the Promoter disclosing its personal information to such commercial partners and the commercial partners contacting the entrant (including for promotional and marketing purposes and/or to provide information about their products, services or events).
35 The Promoter’s Privacy Policy (available at https://www.solotel.com.au/privacy-policy or on request from the Promoter) states how an entrant can seek to access or correct their personal information held by the Promoter and how an entrant can make a privacy complaint to the Promoter. An entrant can contact the Promoter’s Privacy Compliance Officer at privacy@solotel.com.au.
